What is the Second Chance Law?
The Second Chance Law is a regulation approved in 2015 that introduces a mechanism for the exoneration or cancellation of debts through a bankruptcy process for individuals who are in a state of insolvency, either due to a business or labor crisis or due to consumer over-indebtedness.
Can I cancel all my debts?
The Second Chance Law allows the cancellation, with some exceptions such as debts for alimony or derived from crimes, of debts under private law, such as bank loans, debts for supplies, payments to suppliers, etc…
For the time being, debts with the Tax Authorities and Social Security are exonerable up to 10,000 euros each.
Will I lose my home if I take advantage of the Second Chance Law?
The Second Chance Law allows the exoneration without liquidation of the debtor’s assets subject to a payment plan, therefore in some cases the exoneration of debts is compatible with the preservation of the debtor’s habitual residence.
What are the requirements to qualify for the Second Chance Law?
In general, the measure of exoneration of unsatisfied liabilities requires that the applicant be a bona fide debtor.
This implies:
Not having been convicted in the previous ten years for crimes against patrimony.
Not having been sanctioned for very serious infractions against the Treasury or Social Security.
Not having been declared guilty in the insolvency proceeding.
Comply with the duties of collaboration with the insolvency administration.
